Clear ground rules

Terms & Conditions

The rules for using this website and starting a business engagement with Media Buying Maxxing.

The short version

This is a business-to-business website. The pages explain the service, but your signed proposal or agreement defines the actual work, price and responsibilities. Advertising performance can be managed and improved, never guaranteed.

1. Operator and scope

This website and the Media Buying Maxxing service are operated by:

Legal entity
FRACTAL ADVERTISING SRL
Email
hello@mediabuyingmaxxing.com

These terms govern use of this website. They also set the default framework for enquiries and business-to-business services, but a signed proposal, order form or services agreement takes priority if it says something different.

2. Business users only

The services are offered to companies, authorised professionals, organisations and people acting for business purposes. They are not offered through this website to consumers acting outside a trade, business or profession. By requesting services, you confirm that you have authority to act for the business you identify.

3. Website information is not an offer

The website explains our approach, examples and indicative packages. It is an invitation to discuss services, not a binding offer. A service engagement begins only when both parties agree the scope, deliverables, timing, fees and other commercial terms in writing. We may accept or decline an enquiry at our discretion.

4. Services and changes

Services may include account audits, campaign setup and management, tracking and attribution, funnel analysis, testing, reporting and strategic support. The exact work is defined in the applicable proposal or agreement. Changes to scope, platform mix, deliverables or timing must be agreed in writing and may change the fee or delivery schedule.

5. Fees, taxes and payment

Website prices are indicative, stated in EUR and exclude VAT or other applicable taxes unless expressly stated otherwise. The accepted proposal or agreement sets the final fees, invoicing schedule, payment deadline, currency and any media budget. Advertising spend, software, production and third-party costs are separate unless expressly included. Late payment may lead to suspended work and statutory interest or recovery costs permitted by Romanian law.

6. Client responsibilities

You agree to provide accurate, timely and lawful information, approvals, access and materials needed for the work. You remain responsible for:

  • your products, events, offers, pricing, ticket availability and fulfilment;
  • the accuracy and legality of claims, landing pages, databases and materials you supply;
  • holding the rights and permissions needed for all supplied copy, images, video, audiences and personal data;
  • your privacy notices, consent mechanisms and other compliance duties for your own properties and campaigns;
  • reviewing and approving work promptly and protecting access credentials.

Delays, incomplete information or access restrictions may affect timing and results.

7. Advertising platforms and results

Advertising platforms, browsers, devices, ticketing systems and other third parties are outside our control. Their policies, algorithms, inventory, attribution, account decisions and availability can change. We do not guarantee approval, uninterrupted delivery, a particular number of sales, return on ad spend, revenue or other commercial result. Case studies describe past work in its own context and are not promises of future performance.

8. Intellectual property

The website, its copy, design, methods and original materials belong to FRACTAL ADVERTISING SRL or its licensors and may not be copied, republished or commercially exploited without written permission. Ownership and permitted use of client deliverables are governed by the applicable proposal or agreement. Until all related invoices are paid, no transfer or licence beyond review and approval is granted. Each party keeps ownership of materials it owned before the engagement.

9. Confidentiality and data protection

Each party must protect non-public commercial, technical and customer information received from the other and use it only for the agreed work, except where disclosure is required by law or the information is already lawfully public. Each party is responsible for its own data-protection obligations. Where we process personal data solely on a client's instructions, the parties will put an appropriate data-processing agreement in place when required. Website processing is described in the Privacy Policy.

10. Suspension and termination

Project duration, cancellation, notice and termination rights are set in the applicable proposal or agreement. Unless that document states otherwise, we may suspend work for overdue payment, missing access, unlawful instructions, platform-policy risk or a material breach. On termination, fees and approved third-party costs incurred up to the effective date remain payable. Terms intended to survive, including payment, confidentiality, intellectual property, liability and dispute provisions, continue to apply.

11. Liability

Nothing in these terms excludes liability that cannot lawfully be excluded. To the maximum extent permitted by law, neither party is liable for indirect or consequential loss, loss of profit, revenue, opportunity, goodwill or anticipated savings arising from the website or services. Unless the applicable agreement provides otherwise, FRACTAL ADVERTISING SRL's aggregate liability connected with a service is limited to the fees paid for that service during the three months preceding the event giving rise to the claim.

The website is provided on an “as available” basis. We take reasonable care but do not warrant that it will always be uninterrupted, error-free or suitable for a particular purpose.

12. Acceptable use and links

You must not misuse the website, interfere with its operation, attempt unauthorised access, introduce malicious code, scrape it at unreasonable scale or use its content unlawfully. Links to third-party sites are provided for convenience; we do not control or endorse their content, terms or availability.

13. Governing law and disputes

These terms and non-contractual obligations connected with them are governed by Romanian law. The parties will first try in good faith to resolve a dispute through written discussion. If no resolution is reached, the competent Romanian courts have jurisdiction, subject to any different forum expressly agreed in the applicable services agreement or required by mandatory law.

14. Changes and contact

We may update these website terms to reflect changes in the site, services or law. The version in force when you use the site applies to that use; changes do not rewrite an existing signed agreement unless agreed in writing. Questions can be sent to hello@mediabuyingmaxxing.com.
